1. Introduction
These Terms and Conditions ("Terms") govern your use of the website www.celebrantjo.com ("the Website") and the celebrant services provided by Jo Phillips, trading as Celebrant Services by Jo ("Jo", "I", "me", "my"). By accessing the Website or engaging my services, you agree to be bound by these Terms.
Jo Phillips is an independent celebrant based in South-West England and South Wales, offering services including weddings, vow renewals, naming ceremonies, and funeral and memorial ceremonies.

2. Booking and Engagement of Services
2.1 Initial Consultation
I offer a free, no-obligation initial consultation to discuss your requirements. This consultation does not constitute a booking or guarantee availability for your chosen date.
2.2 Confirming a Booking
A booking is only confirmed once:

I have confirmed my availability in writing (by email or message);

A signed booking agreement or contract has been exchanged; and
-
A non-refundable retainer (as specified in your booking agreement) has been received.
Until all three of these conditions are met, your date remains available to other clients.
2.3 Booking Agreement
A separate booking agreement will be provided for each engagement. This will set out the specific services to be provided, the agreed fee, payment schedule, and any other terms specific to your ceremony. In the event of any conflict between these Terms and your booking agreement, the booking agreement shall take precedence.
3. Fees and Payment
3.1 Fees
The fees for my services are as set out in your booking agreement or as quoted in writing. All fees are inclusive of VAT where applicable (please note that as a sole trader I may not currently be VAT registered; I will confirm this if relevant).
3.2 Retainer
A non-refundable retainer, as specified in your booking agreement, is required to secure your date. This retainer is non-refundable except in circumstances described in Section 5 below.
3.3 Balance Payment
The balance of the agreed fee is due by the date specified in your booking agreement. Late payment may result in cancellation of the booking, with the retainer forfeited.
3.4 Additional Expenses
Any reasonable travel, accommodation or other expenses agreed in advance will be charged in addition to the service fee and will be itemised in your booking agreement.
4. Ceremony Preparation
I will work collaboratively with you to craft a personalised ceremony. You agree to:

Provide accurate and complete information about yourselves, the ceremony, and any individuals involved;

Respond to communications and requests for information in a timely manner;

Review and approve the ceremony script within the timeframes I provide;

Notify me promptly of any changes to circumstances, venue, or ceremony requirements.
All ceremony scripts, words and materials produced by me remain my intellectual property, though you are granted a personal licence to use them for the purpose of your ceremony.
5. Cancellation and Postponement
5.1 Cancellation by the Client
If you wish to cancel your booking, you must notify me in writing as soon as possible. The following cancellation policy will apply unless otherwise stated in your booking agreement:

More than 12 weeks before the ceremony: retainer forfeited; no further charge.

Between 6 and 12 weeks before the ceremony: 50% of the remaining balance is due.

Fewer than 6 weeks before the ceremony: 100% of the total agreed fee is due.
These cancellation charges reflect the work already undertaken and the likelihood that I will be unable to re-book the date.
5.2 Postponement by the Client
If you wish to postpone your ceremony to a new date, I will make every effort to accommodate the change subject to my availability. An administration fee may apply. If I am not available for the new date, the cancellation terms in Section 5.1 will apply.
5.3 Cancellation by Jo
I reserve the right to cancel your booking in exceptional circumstances beyond my control (for example, serious illness, bereavement, or unforeseen emergency). In such circumstances I will give you as much notice as possible, endeavour to help you find a suitable alternative celebrant, and refund any fees paid (including the retainer) in full.
I will not be liable for any additional losses or costs arising from a cancellation made under these circumstances.
6. Ceremonies and Legal Status
Please note that as an independent celebrant I am not a registrar and ceremonies conducted by me do not have automatic legal standing. If you require your marriage, civil partnership or other ceremony to be legally recognised, you must make separate arrangements with the local register office or other legally authorised body.
It is your responsibility to ensure all legal requirements are met. I am happy to advise you on this process but cannot accept responsibility for any legal steps not taken.
7. Limitation of Liability
To the fullest extent permitted by law:

My total liability to you in connection with the services shall not exceed the total fees paid by you for those services.

I shall not be liable for any indirect, consequential, or special losses, including loss of enjoyment, disappointment, or any costs arising from circumstances beyond my reasonable control.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other matter which cannot be excluded or limited by law.
8. Intellectual Property
All content on this Website, including but not limited to text, images, graphics, and design, is the intellectual property of Jo Phillips or used with appropriate permission. You may not copy, reproduce, or distribute any content from this Website without my prior written consent.
Ceremony scripts, readings, and other materials created by me are provided solely for your personal use in connection with your ceremony and may not be published, shared commercially, or used for any other purpose without my written permission.
9. Photography, Video and Testimonials
I may take photographs or short video clips at ceremonies for my own portfolio and marketing purposes. I will always seek your permission in advance and will not share images in which you are clearly identifiable without your explicit consent.
If you choose to share a testimonial or review, you grant me permission to quote and use this on my website, social media, and other promotional materials.
10. Data Protection and Privacy
I take the privacy of your personal data seriously. Any personal information you provide will be processed in accordance with my Privacy Policy, available at www.celebrantjo.com/privacy-policy, and in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
I will only use your personal data to provide the services you have requested and will not share it with third parties without your consent, except where required by law.
11. Use of the Website
You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use of the Website.
While I take reasonable steps to ensure the Website is accurate and up to date, I make no warranty that the content is complete, accurate, or free from errors. The Website is provided on an "as is" basis.
I reserve the right to modify, suspend, or discontinue any part of the Website at any time without notice.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or from the services I provide shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Your statutory rights as a consumer are not affected by these Terms. For more information about your rights, you may contact Citizens Advice at www.citizensadvice.org.uk.
13. Changes to These Terms
I reserve the right to update these Terms from time to time. Any changes will be posted on this page with an updated date. Your continued use of the Website or engagement of my services following any changes constitutes your acceptance of the revised Terms.
